Terms of Service

These Terms of Service (the “Terms”) are a binding agreement between you and Cardbrd LLC (“Cardbrd,” “we,” “us,” or “our”) governing your access to and use of the Cardbrd website, mobile application, and related services (collectively, the “Service”). By creating an account, checking the box to accept these Terms, or otherwise accessing or using the Service, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old to use the Service, and at least 18 (or the age of majority where you live) to purchase a paid subscription. By using the Service you represent that you meet these requirements and that the information you provide is accurate. If you use the Service on behalf of an organization, you represent that you are authorized to bind that organization to these Terms.

Subject to these Terms, Cardbrd grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your own personal, non-commercial collection-tracking purposes. We reserve all rights not expressly granted. You may not copy, modify, distribute, sell, lease, reverse-engineer, or create derivative works from any part of the Service except as permitted by law.

4. Your content

The Service lets you record cards, collections, sales, trades, shows, images, and related data (“Your Content”). You retain ownership of Your Content. You grant Cardbrd a worldwide, non-exclusive, royalty-free license to host, store, reproduce, and display Your Content solely as needed to operate and provide the Service to you. You are solely responsible for Your Content and represent that you have the rights necessary to submit it and that it does not violate any law or third-party right.

5. Pricing and valuation data — no guarantee

Important. Card prices, market values, and analytics shown in the Service are estimates aggregated from third-party sources (such as TCGplayer, PriceCharting, SportsCardsPro, and others). They are provided for informational and convenience purposes only.

6. User-to-user sales, trades, and proposals

The Service includes features that let users send and receive sale or trade proposals and communicate with one another. Any transaction, offer, payment, shipment, or exchange between users is solely between those users.

8. Acceptable use

You agree not to: (a) use the Service for any unlawful, fraudulent, or harmful purpose; (b) upload content that is illegal, infringing, defamatory, or violates another’s rights; (c) harass, defraud, or deceive other users; (d) attempt to access accounts or data that are not yours; (e) interfere with, overload, scrape, or disrupt the Service or its infrastructure; (f) circumvent usage limits or security measures; or (g) use the Service to build or train a competing product.

9. Intellectual property

The Service, including its software, design, branding, and the “Cardbrd” name and logo, is owned by Cardbrd LLC and protected by intellectual-property laws. Trading-card names, images, characters, and trademarks (including those associated with Pokémon, One Piece / Bandai, and sports properties) are the property of their respective owners. Cardbrd is an independent collection-tracking tool and is not affiliated with, endorsed by, or sponsored by any card publisher, manufacturer, grader, or marketplace.

10. Third-party services

The Service relies on and links to third-party services (including hosting, authentication, payment, pricing-data, and image providers). Your use of those services may be governed by their own terms and privacy policies. Cardbrd is not responsible for third-party services and disclaims liability for their availability, content, or practices.

11. Disclaimer of warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, ACCURACY, AND NON-INFRINGEMENT. CARDBRD DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR THAT ANY DATA (INCLUDING PRICING DATA) WILL BE ACCURATE OR RELIABLE. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CARDBRD LLC AND ITS OWNERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR THE VALUE OF ANY CARD OR COLLECTION, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT WILL CARDBRD’S TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID CARDBRD IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE LIABILITY, OR (B) USD $50.

13. Indemnification

You agree to defend, indemnify, and hold harmless Cardbrd LLC and its owners, employees, and agents from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of or related to Your Content, your use of the Service, your transactions with other users, or your violation of these Terms or any law or third-party right.

14. Termination

You may stop using the Service and delete your account at any time from within the app. We may suspend or terminate your access at any time if you violate these Terms or if we discontinue the Service. Upon termination, the licenses granted to you end. Sections that by their nature should survive (including ownership, disclaimers, limitation of liability, indemnification, and governing law) survive termination.

15. Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will update the version and effective date above and, where appropriate, ask you to re-accept the Terms before continuing to use the Service. Your continued use after an update means you accept the revised Terms.

16. Governing law and disputes

These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict-of-laws rules. You and Cardbrd agree to submit to the exclusive jurisdiction of the state and federal courts located in Cumberland County, Pennsylvania for any dispute not subject to arbitration, and you waive any objection to venue there. If any provision of these Terms is held unenforceable, the remaining provisions will remain in effect.
